When someone is arrested, regardless of the crime, they are processed into a detention facility where they are held. At this time they will go before a judge and the court will usually set a bail which is the amount for which the defendant is indemnified. The court will require 10% of the bail amount posted for the incarcerated person to be released.

Bail is cash, a bond or property that an arrested person or someone on their behalf gives to a court as collateral to ensure that he or she will appear in court when ordered to do so, to face their charges.
If the defendant doesn’t show up, the court will keep the bail and issue a warrant for their arrest.
If bail is not posted, the defendant will remain in jail until the charges can be resolved, even if they are found innocent. This can be weeks or months, depending on the charges.
